These Terms of Service ("Terms") govern your access to and use of the ResumeParser API, including any associated documentation, software, and services (collectively, the "Service"). ResumeParser API is a service that allows you to convert unstructured resume documents into structured, machine-readable data. The Service accepts various document formats and returns parsed resume data via API responses.

4. Payment Terms

The Service offers various subscription plans with different features, limitations, and pricing. Current pricing and plan details are available on our website. We reserve the right to change pricing and plan offerings at any time, with notice to existing subscribers.

4.2 Billing and Payment

By subscribing to a paid plan, you agree to pay all fees associated with your selected plan. Fees are due in advance and are non-refundable. You authorize us to charge your payment method for all applicable fees. If your payment method fails, we may suspend your access to the Service.

If you exceed the usage limits of your subscription plan, you will be charged overage fees as specified in your plan details. Overage fees will be billed at the end of the billing cycle or when they reach a certain threshold.

We may offer a free trial of the Service. At the end of the trial period, you will be automatically charged for the selected subscription plan unless you cancel before the trial ends.

All fees are exclusive of taxes. You are responsible for paying all applicable taxes, including sales, use, VAT, and other similar taxes, if any.

5.1 Resume Data

When you submit resumes to our Service for parsing, we process this data transiently. We do not store resume data after processing is complete. Once we return the structured data to you, the original resume and extracted information are purged from our systems.

5.2 Privacy Policy

Our Privacy Policy explains how we collect, use, and protect information when you use our Service. By using the Service, you consent to the data practices described in our Privacy Policy.

5.3 Data Security

We implement reasonable security measures to protect your data during transmission and processing. However, no method of electronic transmission or storage is completely secure. We cannot guarantee the absolute security of your data.

5.4 Data Ownership

You retain all rights to the data you submit to the Service. You grant us a limited license to use this data solely for the purpose of providing the Service to you.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL BE LIMITED TO THE GREATER OF:

In the event of any dispute arising out of or in connection with these Terms or the Service, the parties shall first attempt to resolve the dispute through amicable negotiations.

If the dispute cannot be resolved through negotiations within thirty (30) days, either party may submit the dispute to the competent Dutch court. For consumers, disputes may be submitted to the court of your place of residence.

Any legal proceedings under these Terms will take place on an individual basis; class actions are not permitted under Dutch law.

Any cause of action arising out of or related to the Service must commence within the applicable statutory limitation period under Dutch law after the cause of action accrues.

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings, whether written or oral.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by our authorized representative.

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

Any notices or other communications provided by us under these Terms will be given by posting to our website or by sending to the email address associated with your account. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.

15.6 Force Majeure

We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, civil unrest, network or power outages, or government restrictions.
